Agreement to Terms

By accessing and using the services provided by OpenGenX Technologies Private Limited ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

Services

OpenGenX provides software development, web development, mobile app development, and related technology services. The specific scope of services will be detailed in individual project agreements or contracts.

User Responsibilities

As a user of our services, you agree to:

Intellectual Property

All content, features, and functionality of our services are owned by OpenGenX Technologies and are protected by international copyright, trademark, and other intellectual property laws. Unless otherwise specified in a project agreement, all work products created by OpenGenX remain our intellectual property until full payment is received.

Payment Terms

Payment terms will be specified in individual project agreements. Generally, payments are due according to the milestone schedule agreed upon. Late payments may result in suspension of services and may incur additional charges.

Project Timeline

While we strive to meet agreed-upon timelines, project completion dates are estimates and may be subject to change based on project scope, client feedback, and other factors. We will communicate any timeline changes promptly.

Confidentiality

We respect the confidentiality of your business information and will not disclose it to third parties except as required by law or with your explicit consent. A separate Non-Disclosure Agreement (NDA) may be executed for sensitive projects.

Limitation of Liability

To the maximum extent permitted by law, OpenGenX Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

Warranty Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

Termination

Either party may terminate a service agreement with written notice as specified in the individual project agreement. Upon termination, payment for work completed up to the termination date will be due.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the updated terms on our website with a new "Last updated" date.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Madurai, Tamil Nadu, India.
